1. Preliminary Information
These General Terms and Conditions of Sale (“General Terms and Conditions of Sale”) apply to all sales of Buonocore Gioielli products completed through the website www.buonocoregioielli.com (the “Website”).
DEFINITIONS:
SELLER: Buonocore Gioielli S.r.l., referred to as Buonocore Gioielli;
CUSTOMER: a natural person acting for purposes unrelated to any business, commercial, artisanal, or professional activity they may carry out;
PRODUCTS: all products offered for sale on the website buonocoregioielli.com with corresponding photographs, detailed descriptions, and prices;
CUSTOMIZED PRODUCTS: all products that are modified and personalized at the Customer’s request and therefore differ from the finished products already available for sale on the website.
Buonocore Gioielli S.r.l., headquartered at Via Michelangelo Schipa 115, 80122, Naples (NA), and operational headquarters at Strada provinciale 22 – km 1750, 81025, Marcianise (CE), Italy, Tax Code and VAT No. 04530241217, registered in the Naples Business Register with REA No. NA-699245, is the entity selling the products and providing related services (the “Seller”).

Buonocore Gioielli S.r.l. holds a license for the trade of precious objects under protocol no. 68/2024/P.A.S.I. – Cat. 14/E issued by the Police Headquarters of Caserta province on 11/03/2024.
These General Terms and Conditions of Sale govern all orders placed exclusively through the Website and form an integral part of the purchase order. By placing a purchase order with Buonocore Gioielli, the Customer expressly agrees to be bound also by our Privacy Policy and Cookie Policy, both available on the Website, which are incorporated into these General Terms and Conditions of Sale and consequently accepted.
These General Terms and Conditions of Sale can be downloaded from the Website and are available in both Italian and English.
Italian law regulates distance contracts concluded by consumers under Chapter I of Title III of Part III of Legislative Decree No. 206 of September 6, 2005 (the “Consumer Code”) and other regulatory provisions.
A distance contract is defined as a contract for goods or services concluded between a professional and a consumer within a system for the sale or provision of services. A distance contract may be concluded through any suitable means (e.g., telephone, e-mail, catalog) without the physical and simultaneous presence of the contracting parties.
This legislation applies in particular to online sales.
2. Periodic Updates to the General Terms and Conditions of Sale
Buonocore Gioielli S.r.l. reserves the right to modify the General Terms and Conditions of Sale at any time, with the most recent and updated version always available on the Website. Any update will take effect from the date of publication on the Website and will govern only the orders of products or services concluded from that date onward.
For this reason, before placing an order, Customers are advised to carefully review these General Terms and Conditions of Sale. It is understood that any update to the Terms and Conditions of Sale will always comply with the applicable sector regulations.
3. Eligible Customers
Individuals who meet the following criteria are considered “Eligible Customers” and can place orders for products through the Website:
(a) They have reached the legal age of majority (eighteen years in most countries);
(b) They have the legal capacity to enter into contracts;
(c) They are consumers, meaning they act for purposes unrelated to any business, commercial, artisanal, or professional activity; and
(d) They provide a shipping address in one of the countries listed in Section 10 of these General Terms and Conditions of Sale.
By placing an order through the Website, the Customer expressly declares and warrants that they meet all the above requirements, including but not limited to being a final customer acting in good faith who purchases products or services from the Seller solely for personal use. If these requirements are not met, the Seller reserves the right to assert its rights through appropriate legal channels.
4. Product Availability and Quantity Limits
All orders placed through the Website are subject to automatic confirmation regarding both product availability and order confirmation. Buonocore Gioielli reserves the right to refuse orders exceeding the available quantity of any product at any time and without prior notice.
It may happen that, due to multiple Customers accessing the Website simultaneously, a product marked as available is no longer in stock. Buonocore Gioielli will promptly inform the Customer of this situation, allowing them to choose whether to wait for a new supply with an estimated delivery time, select an alternative product, or cancel the order.
For further information regarding the order procedure, please refer to Section 7 of these General Terms and Conditions of Sale.
5. Customized Products
For specific products, Buonocore Gioielli offers customization services (“Customized Products” as defined in the Preliminary Information). Orders for Customized Products—including, but not limited to, engraved products and products created based on specific Customer requests—cannot be canceled, and withdrawal is not permitted.
Product customization will only proceed after Buonocore Gioielli has verified that the payment has been successfully processed.
Once payment has been made, the cancellation of a customized product order is not possible, and the order will be shipped to the address provided during the checkout process.
Once delivered, Customized Products cannot be returned, exchanged, or refunded, except in cases where return and replacement or refund are required under mandatory legal provisions in the presence of product non-conformities.
If a defect or manufacturing flaw is found in a Customized Product, it must be reported to Buonocore Gioielli within 20 days of discovery, which coincides with the product’s receipt date. Any return must first be approved by Buonocore Gioielli, with the Customer required to provide photographic evidence of the reported defects.
Buonocore Gioielli reserves the right, based on the severity of the detected defect, to repair the Customized Product rather than accept its return.
Additionally, Customized Products may be subject to different shipping and delivery times compared to standard products.
6. Complementary Services
The following complementary services are available free of charge through the Website:
Packaging: Orders will be shipped in a Buonocore Gioielli box, wrapped with Buonocore Gioielli packaging, and accompanied by a Buonocore Gioielli shopping bag.
7. Order Procedure
The order procedure consists of the following steps:
User Registration: To purchase products, registration is not required. However, users may choose to register, which is free, quick, and does not entail any purchase obligation. Upon placing the first order, the user will be automatically registered and will receive a generic password, which can be changed immediately via the link in the confirmation e-mail. The customer agrees to provide correct, truthful, and complete information regarding personal and tax details (tax code and/or VAT number), contact details, and other relevant information necessary for order fulfillment.
Adding to Cart: Once a product is selected, it can be added to the cart by clicking the designated selection button. Multiple products can be added to the cart, forming a single order containing multiple items.
Placing the Order: Once redirected to the cart, the Customer will be automatically guided through the website to complete the order, which will be finalized upon successful payment of the full order amount. Before completing the order, the Customer must carefully read and accept these General Terms and Conditions of Sale. Failure to accept these terms will prevent the order from being completed.
Information and Verification: During the checkout process, before the order is submitted and payment is requested, the Customer has the opportunity to identify and correct any data entry errors and/or supplement the provided information. During checkout, the Customer is required to carefully review and confirm both the order details and personal information (such as e-mail, shipping address, billing address, and payment information).
Order Confirmation: Once the order is submitted through the website, the Customer will receive a written confirmation via e-mail. This confirmation will include order details, product specifications, any personalization and/or gift options, pricing, shipping costs and applicable charges, payment instructions with bank details in case of a wire transfer, the accepted General Terms and Conditions of Sale, applicable special conditions (if any), information on the right of withdrawal or its exclusion, and the order reference number, which should be retained for any future inquiries regarding the order (the “Order Confirmation”). It is the Customer’s responsibility to review the Order Confirmation and ensure that it accurately reflects the intended purchase. If there are any questions or concerns, or if the Order Confirmation does not match the Customer’s intent, it is advisable to contact Customer Service immediately.
After order completion and confirmation, the Customer may access their reserved area on the website through their online account to review purchased products.
Buonocore Gioielli reserves the right to refuse, cancel, or terminate an order for justified reasons at any time before payment. By way of example and without limitation, Buonocore Gioielli may refuse, terminate, or cancel an order if the Customer does not provide sufficient solvency guarantees, if the order is incomplete or incorrect, if the product is no longer available, in case of a dispute regarding the payment of a previous order, or if, at Buonocore Gioielli’s sole discretion, the Customer is suspected of engaging in (i) fraudulent activities or (ii) violating these General Terms and Conditions of Sale.
8. Requirements for Purchases Equal to or Exceeding €12,500.00
For purchases of €12,500.00 or more, Buonocore Gioielli S.r.l. must comply with anti-money laundering regulations in accordance with Legislative Decree 231/2007 and its subsequent amendments. These regulations aim to prevent and combat money laundering and terrorism financing. Below are the details of the requirements for buyers and the legal consequences of non-compliance.
Required Documents and Information:
The Customer must provide the following documents and information:
Identification Document: A valid identification document (ID card, passport, or driver’s license) to verify the identity of the purchasing Customer.
Tax Code: Required to fiscally identify the purchasing Customer.
Proof of Residence: A document confirming the Customer’s residential address, such as a recent utility bill or a bank statement.
Source of Funds: Information regarding the origin of the funds used for the purchase (e.g., income tax return, bank statements, proof of income).
Declaration of Intended Use: In certain cases, a written statement may be required regarding the final use of the purchased goods or services, especially if the item may be used for professional or business purposes.
Reasons for Compliance:
Anti-Money Laundering Regulations: The law requires commercial operators to identify customers and monitor significant transactions to prevent the financial system from being used for illicit purposes.
Prevention of Terrorism Financing: These requirements aim to ensure that funds are not used to finance terrorist activities.
Protection of the Financial System: Verifying the legitimate origin of funds helps maintain the integrity of the financial system and protects businesses from unwitting involvement in criminal activities.
Consequences of Non-Compliance:
If the information provided by the Customer is non-compliant or suspicious, Buonocore Gioielli reserves the right to:
1. Refuse the transaction: If the Customer fails to provide the required documents or if there are suspicions regarding the source of funds, Buonocore Gioielli S.r.l. is obligated to refuse the transaction.
Suspicious Activity Report (SAR): If there are elements of suspicion regarding the source of funds, Buonocore Gioielli S.r.l. may be required to report the transaction to the Financial Intelligence Unit (UIF)
Administrative and Criminal Penalties: The Customer may be subject to administrative or criminal penalties for violating anti-money laundering regulations.
Fund Freezing: In extreme cases, if funds are deemed to have an illicit origin, authorities may request that the funds involved in the transaction be frozen.
9. Prices, Taxes, and Shipping Costs
All prices listed on the Website, on the product pages, or specified by Customer Service include VAT and, unless otherwise stated, exclude shipping costs. The currency applied for purchases with a shipping address within and outside the European Union is always EURO.
The product prices indicated on the website are always clearly visible and specified for each type of product, except for any customizations and specific requests from the Customer, whose cost cannot be predetermined or standardized. The final cost will be communicated by Buonocore Gioielli at the time of order form completion and/or via e-mail and/or upon the Customer’s request to Customer Service.
Buonocore Gioielli S.r.l. reserves the right to charge the Customer for shipping costs based on the commercial policies in place at the time of the order, as determined at its sole discretion. Such costs will be clearly identified and/or communicated during the order placement process. If not explicitly stated, these charges will not be applied.
These shipping costs will be summarized before confirming and completing the order and will also be indicated in the subsequent order summary correspondence with the Customer. Buonocore Gioielli reserves the right to modify prices and delivery costs at any time and without prior notice. However, the applicable shipping costs will be those in effect at the time of order submission, as clearly indicated during the Order Process.
Buonocore Gioielli ensures that product prices and delivery costs are accurate when entering the information into the system or communicating it through Customer Service. In the event that, despite Buonocore Gioielli’s reasonable efforts, certain prices or delivery costs are mistakenly calculated, the Customer will be contacted as soon as possible and given the choice to confirm a new order based on the corrected prices or delivery costs, or to cancel the order. If Buonocore Gioielli is unable to contact the Customer using the contact details provided during the order process, the order will be canceled, and any amounts paid will be refunded.
10. Payment
Buonocore Gioielli S.r.l. reserves the right to charge the Customer for shipping costs based on the commercial policies in place at the time of the order, as determined at its sole discretion. Such costs will be clearly identified and/or communicated during the order placement process. If not explicitly stated, these charges will not be applied.
These shipping costs will be summarized before confirming and completing the order and will also be indicated in the subsequent order summary correspondence with the Customer. Buonocore Gioielli reserves the right to modify prices and delivery costs at any time and without prior notice.
Buonocore Gioielli only accepts the payment methods indicated during the order process on the Website. Depending on the selected payment method, additional information may be required, including specific forms of identification.
When placing an order on the Website, payment details must be entered into the appropriate form. All payment cardholders are subject to validation checks and authorization by the card issuer.
Other payment methods may also be subject to validation and authorization checks by payment system providers. The Customer expressly authorizes Buonocore Gioielli to carry out security checks whenever necessary, including transmitting and/or obtaining information (including updated Customer details and, without limitation, payment card data) from/to third parties. These checks may be conducted to verify identity, validate the payment card, obtain initial authorization for card payment, and authorize individual purchase transactions.
Buonocore Gioielli accepts bank transfer payments. No additional fees will be charged for bank transfers made to settle orders placed through the Website, except for any fees charged by financial institutions. All orders paid via bank transfer must be confirmed through an order approval process. The order will not be processed until Buonocore Gioielli has received the payment and sent the order confirmation via e-mail. If the bank transfer payment is not credited to the bank account within five (5) business days from order placement, the order will be canceled.
11. Shipping
Buonocore Gioielli ships within Italy and internationally via UPS Express Courier.
Please note that Buonocore Gioielli does not accept shipments to military addresses, restricted areas, pickup points, or P.O. boxes. For more information, please contact Customer Service.
All shipments are trackable. Once the order has been shipped, the Customer will receive an e-mail with an order summary and a tracking number that can be monitored on the UPS website. Alternatively, to check the shipping status immediately, the Customer can click on the “Track My Order” button in the footer menu (at the bottom of the page).
Shipping times are explicitly indicated in the order form completed by the Customer. Unless otherwise specified for products not in stock, delivery will always be carried out via express courier within 48-72 business hours.
Specific cases where Buonocore Gioielli may not guarantee delivery within the specified timeframes include:
Custom product requests;
Products not available in stock;
Shipments to foreign and non-EU territories.
12. Delivery
Until full payment has been received, the ordered product(s) remain the property of Buonocore Gioielli S.r.l. The delivery of products is subject to the receipt of full payment. A handwritten or electronic signature from the Customer or another person at the specified delivery address will be required as confirmation of product delivery. Upon delivery, the risk and responsibility for the purchased goods transfer to the Customer. If the Customer has designated a recipient other than themselves for delivery purposes, the Customer expressly agrees that the signature of such recipient (or another person at the delivery address) constitutes proof of delivery, transfer of responsibility to the recipient, and fulfillment of the sales contract by Buonocore Gioielli.
Buonocore Gioielli S.r.l. reserves the right to deliver products exclusively to the intended recipient of the order as indicated on the package label and to request, for certain product categories, identity verification upon delivery. Please contact Customer Service for further information.
Buonocore Gioielli will take all reasonable measures to ensure delivery by the courier within the timeframe specified in the Order Confirmation and, in any case, no later than thirty (30) days from that date. Exceptions include cases where the purchase involves a product or service for which longer delivery times were indicated at the time of ordering, such as customized products or services.
If delivery does not occur within forty (40) days from the Order Confirmation date or within a longer agreed-upon period, the Customer may request that Buonocore Gioielli S.r.l. complete the delivery within an additional reasonable timeframe based on the circumstances.
The Customer is not required to grant Buonocore Gioielli an additional period exceeding forty (40) days for product delivery if:
- il rispetto del termine pattuito dalle parti per la consegna deve considerarsi essenziale, tenuto conto di tutte le circostanze di conclusione del contratto;
- il Cliente ha espressamente informato Buonocore Gioielli, prima della conclusione del contratto, che il termine per la consegna è essenziale. In questi casi, se la consegna non avviene entro il termine di quaranta (40) giorni o quello diverso pattuito dalle parti, il Cliente è legittimato a risolvere immediatamente il contratto, e a ricevere il rimborso di quanto pagato al momento della conferma dell’ordine.
13. Right of Withdrawal and Refund of Paid Amounts
(a) Right of Withdrawal
In full compliance with the regulations on distance contracts and the Consumer Code and subsequent amendments, the Customer has the right to withdraw from the sales contract without providing reasons and without penalties within fourteen (14) days from the date of product delivery (the “Withdrawal Period”). To withdraw, the Customer must contact Customer Service and follow the instructions provided or complete the Withdrawal Form attached as Annex 1 to these Sales Terms and send a printed copy together with the returned product package to Buonocore Gioielli at the address indicated in the form, while also sending a copy via email to: info@buonocoregioielli.com (the “Withdrawal Notification”). In both cases, the Customer must return the products in accordance with this Section. To comply with the Withdrawal Period, it is sufficient to contact Customer Service and follow its instructions, or to send the Withdrawal Notification before the end of the Withdrawal Period.
(b) Return Process
Products must be returned in accordance with this Section within fourteen (14) days from the date of withdrawal. The return shipping costs will be covered by Buonocore Gioielli. Products purchased through the Website can only be returned to the address indicated by Customer Service. It is clarified that products not purchased online through the official website buonocoregioielli.com cannot be returned under these General Sales Terms.
Below are the steps to return a product in compliance with the General Sales Terms:
(i) Contact Customer Service;
(ii) Customer Service will arrange a pickup date. At this stage, the Customer may be asked for information about the product for an initial evaluation of its condition;
(iii) Complete the withdrawal form and send it via email to info@buonocoregioielli.com;
(iv) The return package must include the product and its accessories in new, intact condition, any free items received as part of the order, the certificate of authenticity, and all other documents, in the original box; the package must be sealed and the prepaid return shipping label received with the purchase must be applied (the “Return Package“);
(v) On the agreed date, deliver the Return Package to the courier designated by the Seller’s logistics partner. Given the high individual value of the marketed products, Buonocore Gioielli S.r.l. requires that returns be made exclusively through the courier indicated by its logistics partner and, for this reason, covers the related cost, despite the law allowing it to be charged to the Customer. If the Customer returns the products via mail or another method different from that indicated by Buonocore Gioielli S.r.l., responsibility for loss, theft, damage to the goods, and any other harmful event will be borne by the Customer.
The Customer will be provided with a receipt containing the return tracking number, which must be kept until an order refund confirmation is sent via email by the Seller.
The Customer must keep proof of the return shipment. If such proof cannot be provided, Buonocore Gioielli declines any responsibility. Only products received in compliance with these General Sales Terms will be eligible for refund or replacement.
(c) Condition of Returned Products
Products must be returned intact and in perfect condition, with all protective materials, tags, and labels attached, as well as in the original Buonocore Gioielli box and shipping packaging, including all accessories, documents, and free items received as part of the order. If the product shows signs of wear, damage, or alterations from its original condition, Buonocore Gioielli reserves the right to refuse the return or, alternatively, to reduce the refund amount accordingly.
Buonocore Gioielli S.r.l. will verify that the returned product meets its return conditions through strict quality control procedures and will proceed with the refund only if the conditions are met.
If the product does not meet the return conditions, Buonocore Gioielli is authorized, based on these General Sales Terms, to refuse the refund and return the item to the Customer at their expense.
(d) Non-Refundable or Non-Replaceable Products
As previously stated, the right of withdrawal is always excluded for the supply of personalized products, including, but not limited to, any product made to order according to the Customer’s specifications and engraved products.
(e) Refunds
If the right of withdrawal is exercised and provided that the returned product(s) meet the conditions set forth in these General Sales Terms, Buonocore Gioielli S.r.l. will refund the Customer the purchase price and shipping costs using the same payment method used for the initial transaction.
Buonocore Gioielli S.r.l. will process the refund only after receiving the returned product or proof of its delivery to the designated carrier as per these General Sales Terms. Provided that the return has occurred or proof of delivery has been given, the refund will be issued within fourteen (14) days from the withdrawal notification.
Only the Customer who purchased the product is entitled to receive the refund of the purchase price, and under no circumstances will the right to a refund belong to a person who received the product as a gift. If the recipient of a gift wishes to return a product, they may contact Customer Service to evaluate the available options.
(f) Replacements
A product purchased through the Website may be returned within fourteen (14) days, following the conditions and procedures outlined in these General Sales Terms, in exchange for another Buonocore Gioielli product, provided that the requested replacement product is available and the return complies with the provisions of these General Sales Terms, particularly this Section 12. The process involves withdrawing from the contract for the returned product and placing a new order for the replacement product.
For clarity, the replacement covered in this section (f) is not the legal replacement remedy available to consumers in case of product defects (see Section 13), which remains governed by applicable legal provisions.
To request a replacement and verify the availability of the desired product, the Customer must select the relevant option in the Return Form and contact Customer Service.
If the replacement request is approved, the sale of the returned product will be canceled, and the Customer will receive a notification of a new order for the replacement product. If the replacement product is less expensive, the Customer will receive a refund for the price difference. If the replacement product is more expensive, the Customer must pay the price difference before the new product is shipped.
14. Legal Warranty and Customer Rights
Buonocore Gioielli S.r.l. is committed to ensuring that each product strictly meets the company’s quality standards and has passed all technical and aesthetic inspections. Upon receipt of the products, the Customer should inspect them to check for any defects. If any defects are found, the Customer must notify Buonocore Gioielli as soon as possible.
Please note that Legislative Decree No. 206/2005 (the “Consumer Code”) provides for the legal warranty for conformity defects, under which Buonocore Gioielli S.r.l. is responsible towards the Customer, as a consumer, for any conformity defects that manifest within two years from the delivery of the product. Referring to the text of Legislative Decree 206/2005, we summarize that it provides, in case of conformity defects: (i) the Customer’s right to choose, at no charge, the replacement or repair of the product, unless the chosen remedy is objectively impossible or excessively burdensome compared to the other; (ii) the Customer’s right to choose a price reduction or the termination of the contract, but not for minor defects, in case repair and replacement are objectively impossible or excessively expensive, or the seller fails to repair or replace the product within a reasonable time, or if a previous repair or replacement caused excessive inconvenience to the Customer. Please remember that the notification of the conformity defect must be made, under penalty of forfeiture, within two months from its discovery, and the action to enforce defects that are not intentionally concealed by the seller is subject to a limitation period of twenty-six months from the delivery of the goods. As a consumer, the Customer may have additional rights granted by mandatory laws, which remain unaffected by these Sales Terms.
15. Repairs
For any repair requests related to a product ordered through the Website, the Customer must contact Customer Service. To initiate a repair request, the Customer can use the return form available on the website and select the “Return for repairs” option. Subsequently, our Customer Service team will handle the request, providing all the necessary information to send the product to the Buonocore Gioielli workshop for evaluation and the subsequent intervention.
16. Product Descriptions
The information regarding the products offered for sale by Buonocore Gioielli can be found on the website and in the individual product sheets accessible through the site. Detailed information about each product is published on the site. Buonocore Gioielli is committed to ensuring that the information provided on the site, in advertisements, in catalogs, and by Customer Service, including descriptions, sizes, and colors of products, is accurate and complete.
However, since each Buonocore Gioielli product is unique, crafted with meticulous artisanal work, there may be minute discrepancies in the indicated weight of precious materials or the exact carat weight of stones. Additionally, because Buonocore Gioielli jewelry is made with strictly natural stones, the color tones may vary slightly depending on the place of origin, extraction, treatment, or cut, which always aims to highlight the most beautiful nuances of the natural vein. Small color differences may also depend on the type of technology used to display the jewelry or the normal printing processes.
The weight, carat, and color tone variations mentioned above do not constitute conformity defects of the product, nor do they represent defects or lack of quality. Their presence does not entitle the Customer to exercise the remedies provided by law for conformity defects, defects, or lack of quality. By accepting these General Sales Conditions, the Customer acknowledges and accepts the above.
17. Limitation of Liability
To the maximum extent permitted by applicable law, Buonocore Gioielli denies and excludes any other terms, conditions, and warranties, whether expressed or implied, in relation to the products or services and the Website.
No provision of these General Sales Conditions is intended to limit or exclude Buonocore Gioielli’s liability to the extent that it cannot be limited or excluded by applicable law. Subject to the preceding sentence, Buonocore Gioielli’s contractual, non-contractual, or other liability towards the Customer shall in no event exceed the total amount paid by the Customer for the applicable order related to the product purchase. Buonocore Gioielli also disclaims any liability for any failure or delay in performing its obligations under these Sales Conditions due to causes beyond its control.
18. General Provisions
If any provision of these General Sales Conditions is found to be invalid, even partially, that provision will be considered as not forming part of these General Sales Conditions, and the validity of the remaining provisions will remain unaffected, unless otherwise required by applicable law.
These General Sales Conditions (and the terms incorporated therein by reference), along with the order and order confirmation, constitute the entire agreement between Buonocore Gioielli and the Customer regarding the product or service orders and replace and extinguish any prior agreements, proposals, understandings, commitments, or collateral contracts of any kind, oral or written, between the Parties in relation to the subject matter.
Any failure or delay by Buonocore Gioielli S.r.l. in exercising any of its rights under these General Sales Conditions shall not be interpreted as a waiver of such rights, nor as an acquiescence to the Customer’s breach of any statement, warranty, or obligation under these General Sales Conditions.
The sales contract is made between Buonocore Gioielli S.r.l. and the Customer, and no other person has the right to enforce any of its terms or conditions. The Customer cannot transfer or assign, even partially, the sales contract or any associated right or obligation to third parties without the prior written consent of Buonocore Gioielli S.r.l.
19. Applicable Law and Dispute Resolution
The contract and these General Sales Conditions will be governed by, and interpreted in accordance with, the laws of the country where Buonocore Gioielli has its registered office, therefore Italian law, without reference to the provisions on conflict of laws and with the express exclusion of the United Nations Convention on Contracts for the International Sale of Goods.
Any disputes or controversies arising from the sales contract, including those regarding or in relation to the General Sales Conditions, including their validity, invalidity, violation, or termination, will be adjudicated or arbitrated in accordance with this section.
If the Customer believes there is an issue related to the purchase of products, they may submit a complaint to Buonocore Gioielli S.r.l., addressing it to the contact details specified in Article 19.
The Customer and Buonocore Gioielli agree to make every effort for thirty (30) days to amicably resolve any dispute or disagreement arising, directly or indirectly, from the products or services, the General Sales Conditions, or any violation of them.
If it is not possible to resolve the dispute during the complaint review, Buonocore Gioielli S.r.l., pursuant to Article 141-sexies third paragraph of Legislative Decree 205/2006, will inform the Customer of the competent ADR (Alternative Dispute Resolution) bodies, specifying whether it intends to use such bodies to resolve the dispute.
Buonocore Gioielli S.r.l. informs the Customer, as a consumer, that the European Union has established an online platform for resolving disputes related to the online purchase of goods or services. The platform, called ODR, is managed by the European Commission and can be accessed at the following link: https://webgate.ec.europa.eu/odr. Through the platform, the Customer can consult the list of ADR bodies and initiate an online extrajudicial dispute resolution procedure.
The availability of these tools does not exclude the Customer’s right to assert their claims before the competent judicial authority. If the Customer’s residence or domicile is in Italy, the mandatory territorial jurisdiction belongs to the courts of the place where the Customer resides or is domiciled. The Customer residing or domiciled in a member state of the European Union other than Italy may assert their claims against Buonocore Gioielli S.r.l. before the courts of the member state in which they are domiciled or reside or before the Italian courts, as the country where Buonocore Gioielli S.r.l. has its registered office.
